Terms of Service

1. Acceptance of Terms

By accessing or using the Call A Monster application ("App") provided by Apollo Street Company d/b/a Call A Monster ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Call A Monster is an entertainment application designed for children ages 2-10 that provides simulated monster phone calls and interactions. The App is intended to be used under parental supervision and control.

3. Age Requirements and Parental Consent

The App is designed for children ages 2-10 and must be used under adult supervision. By allowing a child to use the App, you represent that you are the parent or legal guardian of that child and consent to their use of the App in accordance with these Terms.

4. Subscriptions & Payments

Call A Monster offers subscription-based features with recurring charges. By subscribing, you agree to the following:

• You authorize Apple (App Store) or Google (Play Store) to charge your selected payment method and understand that subscriptions renew automatically unless canceled.
• After any free trial period ends, you will automatically be charged the selected subscription amount. To avoid charges, cancel your subscription before the trial period ends.
• No refunds are provided for unused time after cancellation.
• You can manage or cancel your subscription at any time through your App Store or Play Store account settings.

We do not directly store or process your payment details; all payments are handled securely by Apple and Google.

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Supervise children's use of the App at all times
• Monitor and adjust fear levels appropriate to your child's age and sensitivity
• Not use the App in any way that could damage, disable, or impair the service
• Not attempt to gain unauthorized access to any portion of the App

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, audio clips, and software, are owned by Apollo Street Company and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at Privacy Policy.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APOLLO STREET COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

10. Parental Responsibility

Parents and guardians are fully responsible for:

• Determining if content is appropriate for their child
• Monitoring their child's emotional response to the App
• Discontinuing use if the child shows signs of distress
• Using parental controls to customize the experience

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the effective date.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.
